Following a customer’s discovery of an undisclosed peanut in a product, a voluntary recall was initiated for a mixed nuts item marketed in six states along the West Coast. The bulk food wholesaler DSD Merchandisers made the announcement about the recall to the public on June 24th.
A variety of tree nuts, such as almonds, cashews, pecans, hazelnuts, and macadamias, were packaged in a transparent plastic 5-ounce tub for sale. Produce delivery business Farm Fresh to You purchased the containers from DSD. Farm Fresh to You then distributes the items to e-commerce platform subscribers Full Circle and Farm Fresh to You.
A food allergen, as defined by the FD&C Act’s regulations for food labeling, is a component that comes from any of the listed six categories of foods or includes protein from any of the three food groups. Distributors must provide a list of the nine most common food allergies, including fish, crustacean shellfish, milk, eggs, peanuts, tree nuts, wheat, soybeans, and sesame, to comply with FDA requirements. Ninety percent of food allergies are caused by these substances.
Consumers would have gotten the mixed-nuts packets in the mail, according to the FDA announcement, and the label does not include a brand name. A customer contacted DSD via their website to inform them that their mixed nut package included peanuts, even though the allergy was not mentioned on the label. The product was made using the same machinery as a peanut product, according to the label. The reason was determined to be a brief glitch in the company’s systems for changing formulations and package labels.
